YES Essentials® Products
Limited Warranty
Milliken & Company (“Milliken”) is very proud of its innovative YES Essentials® products and our superior customer service. In the unlikely event that you are not satisfied, please contact us to discuss the problem. Due to the custom-made nature of these products, Milliken will only accept returns for defective products in accordance with our return policy and this limited warranty.
Milliken warrants to the initial purchaser (“you”) that your new YES Essentials® product will be free from any manufacturing defects in workmanship or materials and will release common stains under normal conditions and care. This limited warranty is valid for one year from the date of your purchase. To obtain the benefit of this limited warranty, you must follow the care and cleaning instructions provided with your new YES Essentials® product and be a “consumer” (as defined in 15 USC § 2301) residing in the U.S.A. (for commercial uses and buyers who are not consumers, the product is sold on an “as is” basis without any warranty).
This limited warranty is in lieu of all other express warranties. This limited warranty does not cover: stains from paint, urethanes, varnish, dyes, adhesives, tar, gums, waxes or nail polish; stains caused by commercial, abusive or excessive use; or stains caused by fire, smoke, flood or other act of God (or similar conditions). IMPLIED WARRANTIES, INCLUDING (WITHOUT LIMITATION) IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED TO THE SAME ONE YEAR DURATION OF THIS LIMITED WARRANTY.
At Milliken’s option, Milliken will repair or replace any defective product at no charge, or to the extent permitted by law, Milliken may also elect to refund the purchase price of any defective product. THIS IS YOUR SOLE REMEDY UNDER THIS LIMITED WARRANTY. To make a claim, call (888) 937-1241. You must provide proof of your purchase and obtain written or emailed Return Merchandise Authorization (RMA) from Milliken prior to returning any product. Milliken will not be obligated to issue any RMA after one year from the date of your purchase for any alleged manufacturing defects in workmanship or materials, including any failure to release stains. After you have received an RMA, you should arrange and pay to ship the product back to Milliken, and after Milliken has confirmed that the product is covered under this limited warranty, as explained above, Milliken will repair or replace the product (or refund the purchase price) and pay for return shipping. MILLIKEN SHALL NOT BE LIABLE FOR CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL OR SIMILAR DAMAGES.
This limited warranty gives you specific legal rights, and you may also have other rights that vary from state to state. Some states do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. |
